General Terms and Conditions of Sale

These General Terms and Conditions of Sale (GTC) govern the contractual relationship between FineryEmbroidery and its customers regarding the purchase of digital embroidery designs.

1. Acceptance of Terms

By placing an order on https://fineryembroidery.com/, you acknowledge that you have read, understood, and unreservedly accepted these GTC. Any purchase implies full adherence to these terms.

2. Digital Products and Right of Withdrawal

2.1. Immediate Delivery

Our products consist of digital content provided via immediate download upon purchase. By finalizing your order, you acknowledge that the performance of the contract begins immediately upon the transmission of the download link.

2.2. Exclusion of the Right of Withdrawal

In accordance with Article 16(m) of the Directive 2011/83/EU regarding the sale of digital content, you expressly agree that the supply of the digital content begins before the end of the 14-day withdrawal period. Consequently, you explicitly waive your right of withdrawal and acknowledge that no refund or cancellation is possible once the download link has been made available to you.

3. Ordering and Payment

3.1. Process

Once payment is confirmed, the digital products are made available via an order confirmation page and an automated email containing the download links. It is your responsibility to provide a valid email address.

3.2. Finality of Sales

As per the nature of digital goods and the waiver of withdrawal, all sales are considered final and binding upon the confirmation of the payment.

4. Intellectual Property

All digital products offered are protected by international copyright laws and are the exclusive property of FineryEmbroidery. You are granted a personal, non-transferable, and non-exclusive license for personal use. Any unauthorized reproduction, distribution, resale, or commercial exploitation constitutes a copyright infringement and may result in legal action.

5. Technical Issues and Liability

5.1. Limited Warranty

We ensure that our files are tested and functional. Should you encounter a technical defect preventing the use of a file, please contact us within 7 days of purchase. We will investigate the issue and, if a defect is confirmed, provide a replacement or appropriate technical support.

5.2. Liability

FineryEmbroidery shall not be held liable for any indirect damages resulting from the use of the digital files. You are solely responsible for ensuring the compatibility of the files with your hardware and software.

6. Data Protection

Your personal data is processed in accordance with our Privacy Policy. We collect only the information necessary for order fulfillment and communication.

7. Governing Law

These GTC are governed by applicable European law. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the competent courts.
